Abstrakt

Monografia porusza problematykę nagłej konieczności opuszczenia budynku ze względu na pojawiające się w nim zagrożenia życia lub zdrowia ludzi. Choć problem można scharakteryzować jednym zdaniem, to związany jest on z wieloma różnymi aspektami. W każdym kraju, o nawet minimalnej kulturze ratowniczej, występują (przynajmniej teoretycznie) przepisy regulujące zagadnienie ewakuacji tak wprost, jak i pośrednio. Są to zazwyczaj: zasady i sposoby postępowania przy ewakuacjach, wymogi dotyczące konstrukcji budynków oraz – przy bardziej skomplikowanych ich strukturach – narzędzia wspierające, takie jak techniczne systemy zabezpieczeń, detekcja i alarmowanie, stałe i półstałe urządzenia gaśnicze oraz wentylacja pożarowa. W Polsce wymogi te są sprecyzowane przez ustawy, rozporządzenia, normy (niektóre są rekomendowane, ale nie wymagane), wytyczne firm ubezpieczeniowych i instytutów naukowo-badawczych, takich jak np. Centrum Naukowo-Badawcze Ochrony Przeciwpożarowej – Państwowy Instytut Badawczy. Na ich podstawie dla większości budynków, poza mieszkalnymi (kategoria zagrożenia ludzi ZL IV), musi powstać instrukcja bezpieczeństwa pożarowego, z którą powinien zapoznać się każdy stały użytkownik obiektu. Praktyczna weryfikacja zdolności danej organizacji do przeprowadzenia sprawnej i bezpiecznej ewakuacji odbywa się co dwa lata lub corocznie, w zależności od zapisów stosownego rozporządzenia. System wydaje się wiec kompletny i domknięty. W ocenie autora istnieją obszary, w których złożoność procesu, jakim jest ewakuacja, nie jest ujęta żadnymi szczegółowymi regulacjami, bądź potraktowana skrótowo, tak na etapie początkowym – czyli tworzenia przepisów, jak i końcowym – czyli sporządzania instrukcji bezpieczeństwa pożarowego. Najczęściej dopiero etap końcowy uwidacznia obydwa te braki. Już sama nazwa instrukcji sugeruje, że opuszczenie budynku w jego części lub całości odbywa się tylko w przypadku zagrożenia pożarem, w ogóle nie uwzględniając np. zagrożeń terroryzmem lub znajdujących się w bezpośredniej odległości od budynku niewybuchów z okresu II wojny światowej. Jednocześnie, nawet w przypadku zagrożeń pożarowych, w minimalnym stopniu zawarte są w przepisach, a zatem również w instrukcji, potrzeby osób z niepełno-sprawnościami i specyficzne wymogi ich dotyczące. Takich obszarów jest więcej. By je wykazać, w monografii omówiono wszystkie zagadnienia ewakuacji, jakie istnieją w polskich rozwiązaniach prawnych i ich konsekwencje. Zatem, obejmuje zarówno techniczne, jak i formalno-prawne aspekty ewakuacji. Dalej są omówione rzadko w naszym kraju wspominane aspekty psychologiczne oraz przykłady rozwiązań, które mogłyby być z powodzeniem wdrożone (a część z nich już funkcjonuje) w obecnej polskiej konstrukcji prawnej, które są efektem niestandardowego podejścia do problemu. Podstawą analiz porównawczych są rozwiązania anglosaskie, które – w przypadku ewakuacji osób z niepełnosprawnościami – mogą być cenną wskazówką do zmiany sposobu myślenia o takiej ewakuacji jako procesie odbywającym się pod wpływem silnego stresu.
The monograph deals with the issue of a sudden need to leave the building due to threats to human life or health. Although the problem can be summed up in one sentence, it involves many different aspects. In every country with even a minimal rescue culture there are (at least theoretically) regulations regulating the issue of evacuation both directly and indirectly. These are usually: rules and procedures for evacuation, requirements for the construction of buildings and, for more complex structures, supporting tools, such as technical security systems, detection and alarming, fixed and semi-permanent firefighting devices and fire ventilation. In Poland, these requirements are specified by laws, regulations, standards (some are recommended, but not required), guidelines of insurance companies and research institutes, such as, for example, the Scientific and Research Center for Fire Protection – National Research Institute. On their basis, for most non-residential buildings (human risk category ZL IV), a fire safety instruction must be prepared, which must be read by every regular user of the facility. Practical verification of the organization's ability to carry out efficient and safe evacuation takes place every two years or annually, depending on the provisions of the relevant regulation. So the system seems complete and closed. In the authorʼs opinion, there are areas in which the complexity of the process, such as evacuation, is not covered by any detailed regulations, or treated briefly at the initial stage, i.e. creating regulations, and at the final stage, i.e. preparing fire safety instructions. Usually, only the final stage reveals both of these shortcomings. The very name of the instruction suggests that leaving the building, in part or in its entirety, takes place only in the event of a fire risk, without taking into account, for example, threats of terrorism or unexploded ordnance from the Second World War. At the same time, even in the case of fire hazards, the needs of people with disabilities and their specific requirements are treated to a minimum extent in the regulations, and therefore also in the manual. There are more such areas. To demonstrate them, the monograph discusses all the issues of evacuation that exist in Polish legal solutions and their consequences. Thus, it covers both technical and formal and legal aspects of evacuation. Next, the psychological aspects and examples of solutions that could be successfully implemented (and some of them already exist) are discussed in the current Polish legal structure, which are the result of a non-standard approach to the problem. The basis for comparative analyzes are Anglo- Saxon solutions, which in the case of the evacuation of people with disabilities may be a valuable hint to change the way of thinking about evacuation as a process taking place under the influence of strong stress.
